Orissa HC rejects Champua MLA’s plea yesterday

Bhubaneswar, Oct 7: The Orissa High Court on Thursday has rejected the plea to nullify the FIR against Sanatana Mahakud, sitting independent MLA of Champua. The court has decided this as the case against him is being investigated which was lodged by Kavita Mahakud, claimed wife of Sanatana Mahakud’s son.

The court further stated that, after police finishes submitting the charge sheet against him, he can file another fresh appeal.

A complained on harassment had been registered in the Bhubaneswar Mahila Police Station by Kavita who claimed to be the wife of Pankaj Mahakud, against her father-in-law, Sanatana  Mahakud and his son –in-law, Dinabandhu Barik. She also alleged that her in-laws had forcibly kept her husband away from her and also managed to get him married for the second time without her knowing it. She also claimed that she has a daughter from Pankaj.

A case under sections 498A (Husband or relative of husband of a woman subjecting her to cruelty), 341 (Punishment for wrongful restraint), 506 (Punishment for criminal intimidation) and 34 (Acts done by several persons in furtherance of common intention) of the IPC against the MLA and his son-in-law had been registered by the police.
