Bhubaneswar/Jaipur/New Delhi, Apr 5: In connection to the rape of a German student, Bitihotra aka Bitti Mohanty, son of former Odisha top cop BB Mohanty, the prime convict in the rape was refused to get a release from the jail by the Jaipur central jail even though the SC had issued him a bail on Mar 31. The court refused to do so as the SC had granted him bail only in the rape case and not in the parole jump matter. The Jaipur court ordered Bitti to spend three more months in jail for jumping parole after spending seven years of rigorous imprisonment in the rape case. Mohanty’s lawyer has decided to seek the Rajasthan High Court challenging the refusal of Jaipur jail authorities. The lawyer, Sarthak Nayak stated that since the Supreme Court has granted bail, there will be a considerable amount of time when the matter will be listed. An application will be filed under section 482 of CrPc in Rajasthan High Court apprising it of the SC decision. Therefore, the HC can exercise its vested powers and release the accused on bail in parole jump case also. Otherwise, it would be a violation of SC order.
Mohanty was convicted in Mar 2006 for raping a 26-year-old foreign national in a hotel in Alwar in Rajsthan. He was sentenced seven years of imprisonment by Jaipur court but had absconded in 2006 after getting parole making the excuse of visiting his ailing mother. After seven years, he was rearrested in Mar 2013 by the Kerala police from Kannur where he was working in a bank on a fake identity.
