State Govt seeks more time from Orissa High Court on pre-RERA apartment registration

Bhubaneswar: Odisha government has sought additional time from the Orissa High Court (HC) to respond to the issue of registration for pre-2017 apartments. The interim stay on the matter remains in effect until the next hearing.
Amid ongoing uncertainty surrounding the registration of apartments built before 2017, the Odisha government requested more time to submit its response in the High Court. The hearing on the matter took place today. As a result, the interim order previously issued by the court will remain in force until further proceedings.
The case revolves around a government notification that permits the registration of apartments constructed before February 2017. Issued to streamline property registration and offer legal recognition to these properties, the notification has faced legal challenges, prompting intervention from the HC.
According to sources, the Odisha government introduced the notification to address concerns from homebuyers and real estate developers. Many apartments built before 2017 had faced difficulties in obtaining registration due to regulatory and legal ambiguities. The notification was expected to resolve these issues and facilitate the formal registration of such properties. However, several petitions were filed against the notification, alleging violations of legal norms and urban planning regulations.
During the latest hearing, the Odisha government requested the court for more time to file its response and provide necessary clarifications on the matter. The HC acknowledged the request and scheduled the next hearing for next week. Until then, the interim stay on the notification will remain in force, preventing any registrations under the disputed provision.
