Allahabad, April 9 : The Allahabad High Court today stayed a lower court order whereby criminal proceedings had been initiated against summons issued to Bollywood film-maker Rakesh Roshan, his daughter Sunaina and another person in connection with a case of alleged copyright violation.

Justice Suneet Verma stayed the order passed by Additional Judicial Magistrate, Kairana, in Shamli district of Uttar Pradesh on March 11 last wherein Roshan and Sunaina, besides one of their associates, had been directed to appear in person on April 11.

The Kairana court order came on a petition filed by a local resident Manish Shastri who had claimed that the movie “Krrish 3”, released more than two years ago, was based on a script written by him.

Released in November, 2013, the movie had featured Hrithik Roshan and Priyanka Chopra in the lead. Hrithik’s father Rakesh Roshan and sister Sunaina were producer and co-producer, respectively, of the superhero movie which was a sequel to the hugely successful sci-fi thriller “Krrish”.

The father-daughter duo had moved the High Court challenging the lower court order and the case registered against them under Copyright Act and IPC sections pertaining to cheating and forgery.

The court, while granting interim relief to the petitioners, directed the respondents to file counter-affidavit within three weeks and list the case for further hearing thereafter.
